These Terms & Conditions (“T&C”) govern the use of services provided by Mallorca Yacht Management (“we,” “our,” or “us”). By using our website [yourdomain.com] or engaging with our services, you agree to these terms.

2. Services Provided

We offer yacht management services, including but not limited to:

• Yacht Guardianage (regular inspections, security checks, monitoring)
• Yacht Maintenance (cleaning, engine checks, system upkeep)
• Yacht Tuition & Training (on-board training for yacht owners)
• Yacht Refits & Upgrades
• Winterization & Seasonal Care

We reserve the right to modify, add, or remove services at any time.

3. Client Responsibilities

By using our services, you agree to:

• Provide accurate and complete information about your yacht and needs.
• Ensure that your yacht is insured and complies with maritime regulations.
• Inform us of any special requirements or restrictions in advance.
• Grant us access to your yacht for maintenance and agreed services.

Failure to comply with these responsibilities may affect service delivery.

4. Pricing & Payments

• All prices for services will be agreed upon in advance and confirmed in writing.
• Payments must be made as per the invoice terms (e.g., 50% deposit before service, 50% upon completion).
• Late payments may result in additional charges or suspension of services.
• We accept payments via bank transfer, credit card, or other agreed methods.

We reserve the right to adjust prices for future services at any time.

5. Cancellations & Refunds

• Client-Initiated Cancellations:
  • If a client cancels a service more than 48 hours in advance, no cancellation fee applies.
  • If canceled within 48 hours, a 50% cancellation fee may apply.
  • If canceled on the scheduled day, no refund will be issued.
• Company-Initiated Cancellations:
  • If we need to cancel or reschedule a service due to unforeseen circumstances, we will offer an alternative date or a full refund.

No refunds will be given for completed services.

6. Liability & Disclaimers

• We will exercise reasonable care when providing yacht management services, but we cannot be held responsible for damages caused by:
  • Acts of nature (storms, floods, etc.).
  • Third-party service providers (e.g., subcontracted repairs).
  • Pre-existing yacht conditions (e.g., undetected mechanical issues).
• Clients must ensure their yacht is fully insured, as we are not liable for any theft, vandalism, or accidents while the yacht is under our care.

7. Privacy & Data Protection

• All personal data provided will be processed in accordance with our Privacy Policy, in compliance with GDPR and Spanish data protection laws.
• We do not share client data with third parties without consent, except when necessary to provide services.

8. Governing Law & Dispute Resolution

• These Terms & Conditions are governed by Spanish law.
• Any disputes will be resolved in the courts of Palma de Mallorca, Spain.
• We encourage amicable resolution before legal proceedings.

9.  Changes to Terms & Conditions

We may update these T&C at any time. Clients will be notified of significant changes via email or website updates.
